PARTNER VISA

If you want to live in Australia with your partner - citizen or permanent resident of Australia or New Zealand, then you will need to apply for an Australian Spouse (Partner) Visa.

Partner Provisional visa
309 subclass

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. An Australian citizen becomes your sponsor.

With this visa you can:

  • live, work and study in Australia while you are waiting for permanent Partner (Migrant) visa;

  • attend free English language classes.

 

Requirements to married applicants:

  • you must live with your spouse on a permanent basis;

  • your marriage must be valid under Australian law.

 

Requirements to de facto partners:

  • you are not married to each other;

  • your relationship is genuine and continuing;

  • you live together or do not live separately and apart on a permanent basis.

 

Usually your de facto relationship must have existed for at least 12 months immediately before you apply for the visa. This rule doesn’t apply to you if your partner holds or held a permanent humanitarian visa or your de facto relationship existed before he got the visa.

 

You should also meet health and character requirements.

This visa is the first step towards a Permanent Partner visa (subclass 100).

Temporary Partner visa
820 subclass

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily (from 15 to 24 months). 

 

With this visa you can:

  • live, work and study in Australia while you are waiting for a permanent visa;

  • travel to and from Australia as many times as you want;

  • work and study in Australia;

  • attend free English language classes;

  • use the public health system services.

 

Genuine requirements:

 

  • you should be in a genuine relationship with your spouse or de facto partner;

  • you should be in Australia when you apply for this visa.

 

This visa is the first step towards a Permanent Partner visa (subclass 801).

Permanent Partner visa
801 subclass

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently. 

 

With this visa you can:

  • live, work and study in Australia indefinitely;

  • work and study in Australia;

  • sponsor eligible family members to come to Australia;

  • travel to and from Australia for 5 years (after 5 years there are special requirements);

  • apply for Australian citizenship if eligible.

 

Genuine requirements:

  • to  hold a temporary Partner visa (subclass 820); 

  • in most cases, continue to be in a married or de facto relationship with your sponsor.

Partner (Migrant) visa
100 subclass

The visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, live in Australia permanently. It is usually granted to people who hold a temporary Partner visa (subclass 309).

 

With this visa you can:

  • live, work and study in Australia indefinitely;

  • work and study in Australia;

  • sponsor eligible family members to come to Australia;

  • travel to and from Australia for 5 years (after 5 years there are special requirements);

  • apply for Australian citizenship if eligible.

Genuine requirements:

  • to hold a temporary Partner (Provisional) visa (subclass 309); 

  • to be married or in a de facto relationship with your partner.
